IGATE NETWORKS SRL, headquartered in Oradea, Titus Popovici Street, no. 16, registered with the Bihor Trade Register under no. J05/87/2010, with fiscal code RO 26446849, bank account no. RO71BTRLRONCRT066250120, opened at Banca Transilvania, owner and administrator of the website www.curiapost.com, offers postal services for domestic and international shipments, under the following conditions:

 

Orders are exclusively accepted through the platform www.curiapost.com, owned and operated by IGATE NETWORKS SRL. The actual provision of postal services (collection, sorting, transportation, and delivery of postal items) is carried out by the postal service providers with whom we collaborate, on behalf of and on behalf of IGATE NETWORKS SRL.

 

IGATE NETWORKS SRL accepts postal items presented by the sender, properly packaged with an opaque outer covering that does not allow the contents to be viewed and with complete identification details of the recipient, and in the case of the Cash on Delivery service and paper-based postal order and the sender's details (name and surname/business name in the case of legal entities, respectively, full delivery address).

 

The packaging must correspond to the weight, shape, and nature of the content, as well as the mode and duration of transport and protect the content so that it cannot be damaged by pressure or successive handling and may, as appropriate, be in cardboard boxes, plywood, wood, plastic, metal, non-standard packaging.

The responsibility for packaging postal items and entering data on the postal item rests with the sender.

 

Postal items containing fragile goods must be properly packaged by the sender using bubble wrap, wood shavings, anti-shock polystyrene, or other material that reduces mechanical shock, and have the inscription "Fragile" applied.

 

IGATE NETWORKS SRL undertakes to recognize and respect the inscriptions/labels applied by the sender and to pay special attention to handling and storing the relevant postal items.

 

IGATE NETWORKS SRL is not responsible for any alterations to postal items caused by electromagnetic means or causes (for example, demagnetization, X-ray scanning as part of security/customs procedures, etc.).

 

The maximum accepted dimensions of the postal item are:

 

210 mm x 297 mm (A4 format) for envelopes;

50 cm x 70 cm x 120 cm for parcels.

The maximum allowed weight of a postal item is 31.5 kg.

 

IGATE NETWORKS SRL does not accept postal items whose packaging displays inscriptions that contravene public order or good morals, as well as postal items consisting of goods that contravene public order or good morals, if they are deposited unpacked or in transparent packaging or old labels or inscriptions.

 

Likewise, postal items cannot be the subject of goods whose transport is prohibited by legal provisions, even on a portion of the route (for example, but not limited to: explosive, toxic, flammable, psychotropic substances, drugs, weapons or parts thereof, ammunition, etc.).

 

PROHIBITED ITEMS FOR COLLECTION:

 

firearms, rifle, gun, explosives, ammunition, firearm components, knives, ax, stabbing weapons, cutting weapons;

perishable, infectious, putrefying products;

temperature-sensitive products requiring cooling or heating during transport;

alcohol, tobacco in any quantity;

narcotics, other hallucinogenic materials and those defined in the criminal code;

products packaged in bags, household, sacks, cloth bags;

 

dairy products (yogurt, cottage cheese, etc.);

drugs, hallucinogenic substances, psychotropic materials;

liquid products that have not been properly packaged;

flammable materials (e.g., gasoline, diesel fuel, tar, liquefied gas);

distilled spirits, homemade alcoholic products;

cigarettes and other tobacco products;

hazardous materials: explosive materials, inflammable substances, materials with toxic or caustic effects, radioactive materials, infectious or potentially infectious materials, human-hazardous solutions, and any other materials that may have adverse effects (due to their characteristics) on other parcels, personnel, and vehicles;

live or dead animals, plants, flowers, perishable foods;

sanitary specimens (including bodily fluids and tissue samples);

human remains and ashes;

cash (paper or coin) in any currency or payment instruments replacing cash (bank card, debit card, meal vouchers, vacation vouchers), securities (state documents), pre-paid phone cards, activated SIM cards, and even unused stamps, vignettes;

gold bars;

trendy jewelry, jewelry made of precious metals or precious stones;

unique or irreplaceable objects;

materials hazardous to humans and animals that may result in fatality;

objects/instruments/materials specifically hazardous to public safety;

valuable papers, precious metals, precious stones;

household objects made of ceramics or porcelain (e.g., cup, vase);

unpackaged furniture;

glass-fronted cupboards;

champagne or sparkling wine, carbonated beverages;

gas, pyrotechnic devices (e.g., gas spray);

fire extinguisher;

All other objects that theoretically could endanger human life, the environment, public safety, state security, courier, partners, colleagues, and our vehicles.

 

The sender is obliged not to introduce into the postal network postal items whose purpose is prohibited by legal provisions.

 

IGATE NETWORKS SRL ensures the confidentiality of postal items - retention, opening, or disclosure of the contents of postal items being allowed only under the conditions and procedures provided by law.

 

In the case of international postal items, both parties must also comply with the legal provisions applicable in the customs field, as well as the legislation of the states on whose territory the postal services operations are performed and those transited by the postal item.

 

With the exception of postal items that are the subject of the Express service, IGATE NETWORKS SRL ensures the delivery of domestic postal items within 7 business days, respectively, within 30 business days from the date of receipt in the case of international postal items.

 

IGATE NETWORKS SRL provides a registered mail service that offers a flat-rate guarantee against the risks of loss, theft, total or partial destruction, or damage of the registered postal item. The service also provides, upon request, a proof of deposit or delivery of the postal item, without requiring written confirmation from the recipient.

 

The sender may request the release of the proof of deposit or delivery of the postal item within 9 months from the date of its deposit with IGATE NETWORKS SRL. The provider is obliged to send the proof within a maximum of 10 working days from the date of the request, using an agreed method (such as fax, email, paper format, physical format, etc.), without incurring additional costs for the sender.

 

IGATE NETWORKS SRL also provides a declared value mail service, which guarantees a registered postal item against loss, theft, total or partial destruction, or damage, for a sum that cannot exceed the declared value by the sender. The service also provides, upon request, a proof of deposit or delivery of the postal item, without requiring written confirmation from the recipient.

 

The sender may request the proof of deposit or delivery of the postal item within 9 months from the date of its deposit with IGATE NETWORKS SRL. The provider is obliged to communicate the proof within a maximum of 10 working days from the date of the request, using an agreed method with the sender or integrator (such as fax, email, paper format, physical format, etc.), without incurring additional costs for the sender.

 

The maximum accepted value for the declared value service is 9999 RON (or the equivalent in EURO).

 

IGATE NETWORKS SRL also provides a cash-on-delivery service, which involves the payment by the recipient, through the postal network, of the value of the goods that are the subject of the registered postal item to the sender. The provider only accepts these postal items if the sender has correctly and completely indicated all their identification data. The accepted currencies for collecting and paying sums of money from recipients are RON or EURO. The maximum amount accepted by the provider is 10000 RON (or the equivalent in EURO) for legal persons and 5000 RON for natural persons.

 

The sender must mention the amounts to be collected in the currency of the destination country within the order. The sender must also explicitly mention the bank account in which they want the collected sums to be transferred. IGATE NETWORKS SRL will transfer the sums in the currency of the country where the bank transfer is made, with the exchange rate being determined by the bank with which IGATE NETWORKS SRL collaborates, on the day of the bank transfer. The cash-on-delivery will be made only through a collector account.

 

The deadline for returning the value of the postal items to the sender (the sums collected from the recipient) is a maximum of 45 working days from delivery for domestic postal items and 45 working days for international postal items.

 

IGATE NETWORKS SRL provides the Acknowledgement of Receipt service, a postal service that consists of delivering to the sender a proof of delivery of the registered postal item, confirmed in writing by the recipient. The term for returning to the sender the proof of delivery confirmed in writing by the recipient is 45 business days from delivery for domestic postal items and 45 business days for international postal items.

 

In case the proof of delivery of the postal item by the recipient is lost, IGATE NETWORKS SRL prepares and makes available to the sender a duplicate of it.

 

IGATE NETWORKS SRL provides the Postal Money Order service on paper, a postal service that involves filling out a physical form based on which the transfer and reissue of a sum of money to the recipient is executed according to the sender's instructions without any deduction, within 10 business days for domestic postal items and within 20 business days for international postal items. These postal items are accepted only if the sender has correctly and completely indicated all his identification data, by properly completing the standard money order form provided by IGATE NETWORKS SRL.

 

The accepted currency for collecting or paying money is RON or EURO. The maximum amount accepted by the provider is 10000 RON (or the equivalent in EURO) for legal entities and 5000 RON for individuals.

 

IGATE NETWORKS SRL will return, at the sender's expense (according to the tariffs indicated in the commercial offer), the registered postal item that could not be delivered to the recipient due to one of the following reasons:

 

a) the recipient's address does not exist or there is no structure or recipient available to receive the postal item, or no service available to receive the postal item;

b) the recipient or authorized person could not be found at the indicated address, after the expiration, if applicable, of the retention period for delivery;

c) the recipient or authorized person has refused, as applicable, to receive the postal item or confirm receipt in writing, according to the law, in the case of the confirmation of receipt service, or to pay the amount due for the item in the case of the cash on delivery service, or to receive the money in the case of the paper-based money order service.

 

The return of postal items will be made within 45 working days in the case of domestic postal items, and within 90 working days in the case of international postal items, a period that is calculated, as applicable, from the date of the expiry of the retention period notified or from the delivery attempt.

 

In case of failure to meet the deadlines set forth in this document, for all postal services (excluding delivery times for the express service and cases not applicable to special contractual delivery), IGATE NETWORKS SRL will respond to the user by refunding 1% of the tariff of the respective service.

 

In the case of postal items that could not be delivered to the recipient or returned to the sender, IGATE NETWORKS SRL will keep these postal items available for 9 months from the date of their deposit. After this period, unclaimed postal items become the property of IGATE NETWORKS SRL. For any storage of postal items at the disposal of the sender or recipient, IGATE NETWORKS SRL will charge a fee of 1 RON/day, after the expiration of the retention period.

 

IGATE NETWORKS SRL has the right to refuse delivery of a registered postal item to the recipient when, after receiving the postal item, it is clearly evident that it contains prohibited goods or does not comply with the special transport conditions established in accordance with the relevant legislation, namely the legislation of the countries on whose territory the delivery will take place or the countries to be transited, or when, after receiving the postal item, it has caused or is likely to cause imminent damage to persons, the environment, facilities used or other postal items.

 

IGATE NETWORKS SRL is liable for loss, theft or total destruction of domestic postal items as follows:

 

with the entire declared value for a postal item that is the subject of a declared value sending service, whether or not the postal item is also subject to a cash on delivery service;

with the cash on delivery amount for a postal item that is the subject of a cash on delivery service without a declared value;

with an amount equal to 5 times the service fee for postal items that are not the subject of a declared value sending service or a cash on delivery service.

In case of loss, theft or total destruction, in addition to the compensation mentioned above, the collected fees are also refunded.

 

In case of partial loss, damage or deterioration, IGATE NETWORKS SRL is liable for domestic postal items as follows:

 

with the declared value for the missing, destroyed or damaged part or with the corresponding proportion of the missing weight of the declared value for postal items that are the subject of a declared value sending service;

with an amount equal to 5 times the service fee for postal items that are not the subject of a declared value sending service.

For a cash on delivery service, IGATE NETWORKS SRL is liable for the full amount. The amounts whose payment or refund has not been claimed by those entitled to them within 6 months from the date of deposit become definitively won by IGATE NETWORKS SRL.

 

The above-mentioned amounts are increased with the legal default interest that runs from the moment of filing the prior complaint or, as the case may be, of filing the lawsuit, regardless of which of these moments comes first.

 

Complete loss of content is equivalent to loss of the postal item.

 

In case the sender has declared a lower value than the actual one, the compensation is at the declared value level.

 

In case of failure to perform the additional characteristics of postal services specified by the sender through special indications, only the fees collected in addition to the applicable tariff for the standard postal service will be refunded.

 

IGATE NETWORKS SRL is liable for international postal items in accordance with the provisions of the applicable national legislation for domestic postal items.

 

IGATE NETWORKS SRL has the right to refuse delivery to the recipient of a postal item when, after taking over the postal item, it is unquestionably found that it contains goods prohibited for transport or does not comply with special transport conditions established in accordance with the relevant legislation, namely the legislation of the countries where delivery is to be made or the countries to be transited, or when, after taking over the postal item, it has caused or may cause imminent damage to persons, the environment, facilities used, or other postal items.

 

IGATE NETWORKS SRL is liable for loss, theft, or total destruction of domestic postal items as follows:

 

with the full declared value for a postal item subject to a declared value service, including whether or not the respective postal item is subject to a cash on delivery service;

with the value of the cash on delivery for a postal item subject to a cash on delivery service without a declared value;

with an amount equal to 5 times the service fee for postal items that are not subject to a declared value service or a cash on delivery service.

In the event of loss, theft, or total destruction, in addition to the above compensation, the collected fees shall be refunded.

 

In the case of partial loss or damage, IGATE NETWORKS SRL is liable for domestic postal items as follows:

 

with the declared value for the missing, destroyed, or damaged part or with the corresponding share of the missing weight from the declared value for postal items subject to a declared value service;

with an amount equal to 5 times the service fee for postal items that are not subject to a declared value service.

In the case of a postal item subject to a cash on delivery service, IGATE NETWORKS SRL is liable for the full value of the cash on delivery if it has not returned the full value to the sender or with the corresponding difference up to its full value, if the cash on delivery has been partially collected from the recipient.

 

For the postal order service on paper support, IGATE NETWORKS SRL is liable for the full amount. The amounts whose payment or reimbursement has not been claimed by the rightful owners within 6 months from their submission date remain definitively won by IGATE NETWORKS SRL.

 

The legal penalty interest which starts running from the introduction of the prior complaint or, as the case may be, the filing of the lawsuit, regardless of which of these moments occurs first, is added to the amounts mentioned above.

 

The complete loss of content is equivalent to the loss of the postal item.

 

In case the sender has declared a lower value than the actual one, the compensation will be at the declared value level.

 

In case of failure to provide the additional characteristics of the postal services specified by the sender through special indications, only the fees collected additionally compared to the applicable standard postal service fee will be refunded.

 

IGATE NETWORKS SRL is liable for international postal items in accordance with the provisions of the national legislation applicable to domestic postal items.

 

IGATE NETWORKS SRL is exempt from liability in the following situations:

 

the damage occurred as a result of the sender's or recipient's actions;

the user does not have a mailbox installed that allows the delivery of postal items or it does not provide security for postal items or, as the case may be, does not have a service for receiving postal items (e.g., a registry);

the postal item was received without objections by the recipient, except for complaints regarding the loss, theft, partial or total damage or deterioration of the contents of the postal item;

the damage occurred due to force majeure or fortuitous event; in this case, the sender is entitled to a refund of the paid fees, except for the insurance fee.

Mechanism for settling complaints received from users.

 

IGATE NETWORKS SRL has established a mechanism for resolving complaints, especially regarding loss, theft, partial or total destruction, or damage to postal shipments, as well as non-compliance with quality of service conditions (delivery times, returns, etc.) or failure to provide postal services.

 

The sender or recipient dissatisfied with the service provided or not provided correctly may file a complaint within 6 months from the date of the postal shipment.

 

The complaint of the user who considers himself prejudiced or dissatisfied must be made in writing and transmitted to the provider through one of the following methods: through the www.curiapost.com platform or by email at [email protected].

 

IGATE NETWORKS SRL will record the complaint received in the Complaints Register and will confirm receipt to the complainant, and will communicate the allocated registration number through the same method used by the user, either on the www.curiapost.com platform or by email to the email address from which the complaint was received.

 

To resolve the complaint, the complaining user must describe the event (facts, acts, and causes) related to the complaint, formulate their claims, choose the payment method for compensation, and provide information necessary for the payment of compensation (in case the complaint is founded), and attach relevant evidence for conducting accurate and complete analysis corresponding to the complained event (such as, if applicable, a copy of the document proving the payment of the postal service, an invoice issued by the provider, photographs, the packaging of the postal shipment, the destroyed/damaged goods subject to the postal shipment, a copy of the report, etc.), and provide any other information that could be useful for resolving the complaint.

 

Representatives of IGATE NETWORKS SRL will analyze the received complaint, taking into account the evidence provided by the complainant, as well as the relevant information/evidence provided by their employees or third parties involved, and may even request an expertise, when necessary.

 

The complaint will be resolved (involving analysis of the complaint, communication of response, and compensation) by IGATE NETWORKS SRL within 3 months from the date of its submission.

 

In case of complaints resolved favorably, IGATE NETWORKS SRL will compensate the user within 30 days from the finalization of the complaint analysis, without exceeding the 3-month period mentioned above. The payment will be made by bank transfer.

 

If the complaint addressed to the postal services provider IGATE NETWORKS SRL has not been satisfactorily resolved or there has been no response within the period provided in these general conditions for providing postal services, the user concerned may submit a complaint to the regulatory authority, accompanied by evidence of the prior complaint procedure or a lawsuit. The lawsuit can be filed regardless of whether a complaint with the same object has been submitted to the regulatory authority or not.

 

This document is an integral part of the commercial offer of IGATE NETWORKS SRL, representing the general clauses of the individual contract that will be deemed concluded between the sender and IGATE NETWORKS SRL at the time of acceptance of the postal shipment in the postal network.
